Hello and welcome! Thank you for choosing ABCMOBILIER.RO. Below you will find all the details about how our online shop works, your rights and obligations, and ours. Please read them carefully – by placing an order or simply browsing the site, you automatically accept these Terms and Conditions.

2. Definition of terms used

You / Buyer = the natural or legal person placing an order
We / Seller = ABCmobilier . RO S.R.L.
Site = www.abcmobilier.ro
Order = your request to purchase one or more products
Distance contract = the contract concluded between you and us without physical presence

3. Prices

All prices displayed on the site are in Romanian Lei (RON) and exclude VAT (21%).
Prices do not include shipping costs, customs duties or any other additional taxes.
The exact shipping cost will be communicated to you before final confirmation of the order (in the cart and by e-mail).
Promotions and discounts are valid only for the period indicated and are not cumulative unless expressly stated by us.
The website www.abcmobilier.ro is primarily addressed to professional HoReCa customers. Consequently, prices are displayed without VAT, and VAT is transparently calculated at checkout before the order is placed. For any individual visitor, prices excluding VAT are displayed clearly and explicitly so that there is no risk of misleading.

4. How to place an order (step by step)

Add the products to your cart.
Fill in your billing and delivery details.
Choose the payment and delivery method.
You will automatically receive an order confirmation e-mail.
We will call you or write to you within a maximum of 24–48 hours (on working days) for final confirmation and delivery details.
Once you confirm, the order becomes final and enters processing.

4.1. Product and material availability The availability of products, shades, upholstery and materials depends on our suppliers’ stock. Although we constantly update the information on the site, there may be situations where certain materials, colours or products become temporarily unavailable for reasons beyond our control. ABCmobilier.RO reserves the right to modify or cancel an order if the product or the necessary materials are no longer available, with prior notification of the customer and full refund of any amount already paid.

5. Payment methods

Online card payment (VISA / MasterCard) through the secure Netopia Payments processor.
Bank transfer (payment order) – banking details will be sent to you in the confirmation e-mail. Payment is considered completed when the money reaches our account.

6. Delivery

We deliver throughout Romania and to any country in the European Union.

To best protect the furniture during transport, we do not use standard fast courier services. Delivery is carried out exclusively through one of the following options:

a) Transport with our partner companies specialised in palletised and bulky goods

We work with reliable carriers who regularly deliver furniture and large-volume items
The cost and delivery time will be communicated to you before final confirmation of the order
Delivery is made to the indicated address (kerbside delivery)

b) Carrier chosen and contracted directly by you

After full payment of the order, we hand over the goods to the carrier you have contracted
From that moment, the risks and responsibility for the products pass to you

c) Personal collection

Possible only in exceptional cases, from our partners’ premises (manufacturers’ factories and warehouses)
Only with prior appointment (minimum 48 hours) and only after our written confirmation
The exact location will be communicated to you at the time of order confirmation

d) Transfer of risk

The risk of loss or damage passes to the buyer at the moment the goods are handed over to the carrier.
Please check the integrity of the package upon delivery and note any damage on the carrier’s waybill (CMR, AWB or any other accompanying document), as subsequent complaints that are not recorded cannot be resolved.

The delivery term is generally between 3 and 20 working days, depending on the type of product ordered and availability, from the order confirmation. We will always communicate a realistic estimated term before you finalise the order.

6.1. Material availability and impact on delivery times Production and delivery times depend on the availability of materials, components and colours from our suppliers. If certain materials become temporarily unavailable, the delivery term may be extended. Such situations are beyond our control, and the customer will be informed as soon as possible of the new estimated term. ABCmobilier . RO S.R.L. cannot be held liable for delays caused by temporary unavailability of materials.

7. Right of withdrawal (for consumers only)

If you are a natural person (consumer), you have 14 calendar days from receipt of the product to change your mind without giving any reason.

Exceptions: custom-made furniture (special colours, dimensions, chosen upholstery) cannot be returned (Art. 16(c) of Government Emergency Ordinance 34/2014).
Send us an e-mail to info@abcmobilier.ro stating that you withdraw, and we will explain the next steps.
You return the product in its original, complete and undamaged packaging (at your expense, except where the product arrived defective).
We will refund the full amount (including the initial shipping cost you paid) within a maximum of 14 days from receipt of the return, using the same payment method.

8. Legal warranty

a) For natural-person buyers (consumers) All products benefit from a 2-year legal conformity warranty starting from the delivery date (according to Government Emergency Ordinance 34/2014 and Law 240/2021). If a lack of conformity occurs during this period that is not caused by improper use, you may choose between:

free repair of the product
replacement with an identical or similar product
appropriate price reduction
full refund

b) For legal-entity buyers or self-employed persons (PFA) The legal warranty is 1 year from the delivery date (Art. 1710 Civil Code). The conditions for granting the warranty (repair, replacement, refund) are the same as above.

c) Regardless of the type of buyer The warranty does not cover normal wear and tear, improper use, non-compliant assembly or unauthorised interventions.

9. Personal data protection

We process your data exclusively for order processing, delivery and commercial information (if you have given your consent). Full details can be found in: → Privacy Policy → Cookie Policy

10. Force majeure

If force majeure events occur (natural disasters, strikes, governmental restrictions, etc.), neither party shall be held liable for delay or non-performance.

If we are unable to resolve a possible dispute amicably, the dispute shall be submitted for resolution to:

the competent courts at our registered office (Focșani Court / Vrancea Tribunal) if you are a legal entity or self-employed person (PFA);
the competent courts according to the law if you are a consumer (natural person), in which case you also have the right to choose the court at your domicile.

12. Amendments to the Terms

We reserve the right to modify these Terms at any time, but changes will not apply retroactively to orders already confirmed. The current version is always published here with the date of the last update.

13. Intellectual property

No element of this site (texts, photographs, logos, trademarks, design) may be reproduced, distributed or used for commercial purposes without our prior written consent.

“ABCmobilier®”, the logo and the slogan “we do it your way” are trademarks registered at EU level (EUIPO) under number 019160714 (03.08.2025).

Any unauthorised reproduction, distribution, copying or use of these elements without our prior written consent constitutes an infringement of intellectual property rights and may be sanctioned under Law no. 8/1996 on copyright and related rights and EU Regulation 2017/1001 on the European Union trademark.
