General Information
The online store www.abcmobilier.ro contains various types of information (texts, images, databases, products, prices, logos, advertisements), which constitute the content of the online store www.abcmobilier.ro, owned by ABCMOBILIER.RO S.R.L. Any reproduction of the content (in full or partially) for purposes other than personal use is sanctioned by intellectual property laws.

The information provided on this site is in Romanian, without excluding its presentation in other languages. The sales contract is concluded in Romanian.

Accessing and/or using the website constitutes ACCEPTANCE of these terms and obliges you to comply with them.

Any information regarding the contract concluded between you and ABCMOBILIER.RO S.R.L. will be stored for a limited time and will only be available to third parties upon request by judicial authorities.

Any confirmed order involves both the seller and the consumer – an individual – in a distance contract.

A distance contract is concluded between ABCMOBILIER.RO S.R.L., as the seller, and a consumer – buyer, within this sales system organized by ABCMOBILIER.RO S.R.L., using exclusively, before and at the conclusion of this contract, remote communication techniques included in the online store.

The moment of concluding the distance contract with the individual, respectively, the moment of concluding the sales contract with the legal entity, is when the consumer receives a confirmation message regarding their order.

After the order is processed by ABCMOBILIER.RO S.R.L., we do not assume any responsibility resulting from the transmission of incorrect data by you.

Regarding relevant codes of conduct, according to Art. 8, lit. e) of Law no. 365/2002 regarding electronic commerce, Law 363/2007 on combating unfair practices, please consult the specific legislation displayed on the ANPC website, under the “Normative Acts” section.

The provisions of this distance contract are supplemented by Law 365/2002 regarding electronic commerce, republished and amended, and by Emergency Ordinance 34/2014 regarding consumer rights in contracts concluded with professionals.

Definitions of this document

ABCMOBILIER.RO S.R.L. accepts the conclusion of distance contracts via electronic means and undertakes to comply with the applicable legislation concerning the conclusion, validity, and legal effects of these contracts. In this document, the following terms used in uppercase letters will have, unless the context indicates otherwise, the meanings specified below:

USER: any person who visits and/or interacts with the website www.abcmobilier.ro;
SELLER: ABCMOBILIER.RO S.R.L., based in Focsani, Republicii Street, no. 1, Vrancea County, Romania, registered at the Trade Register under no. J39/120/2017, with C.U.I: RO37102557, referred to as ABCMOBILIER.RO S.R.L.;
BUYER: Any individual or legal entity that places an order in the online store www.abcmobilier.ro and has accepted the terms and conditions of this distance contract;
ONLINE STORE: web pages owned by ABCMOBILIER.RO S.R.L. located at www.abcmobilier.ro, through which the buyer has access to information about the products offered for sale by ABCMOBILIER.RO S.R.L.;
GOODS: products made available to the buyer for sale by the seller through the online store www.abcmobilier.ro;
ONLINE ORDER: an online communication between the seller and the buyer, through which the buyer intends to purchase goods from the seller, which the seller agrees to deliver, and the buyer agrees to pay;
CONFIRMED ORDER: an order placed online through the www.abcmobilier.ro online store by a buyer whose identification details and order information have been validated via telephone following contact with the ABCMOBILIER.RO S.R.L. customer support operator;
NEW CUSTOMER: a customer who intends to purchase products from the www.abcmobilier.ro online store for the first time and requires a phone validation of the order by the designated ABCMOBILIER.RO S.R.L. customer support operator.

Operating Hours

Orders can be placed online at any time, but processing occurs daily between 8 AM and 9 PM.

Orders placed on Saturdays, Sundays, and public holidays will be processed on the next working day.

If the client is new, the seller assumes acceptance of the order when there is a confirmation by phone or email.

Once the online order is placed, the buyer agrees to the form of subsequent communication (either by phone or electronically), as well as with the seller’s operational process.

Seller’s Obligations

The seller provides the buyer with professional information free of charge about the products and services offered to fulfill the purpose mentioned in the online order. The content published in the online store www.abcmobilier.ro is indicative and presents information about the products sold by ABCMOBILIER.RO S.R.L. as well as other data considered by ABCMOBILIER.RO S.R.L. to be of interest to buyers.

ABCMOBILIER.RO S.R.L. holds all intellectual property rights over the online store, including trademarks, design, website functionalities, images, and technical specifications.

The characteristics of the products and the technical documentation associated with them, presented on the site, are provided by the manufacturers and suppliers, and ABCMOBILIER.RO S.R.L. offers technical support for displaying them.

The seller consistently makes efforts to present accurate and relevant information about the products offered for sale. If the prices or other information about the products are incorrectly displayed, we reserve the right to not honor the order and to inform the customer about the error if the delivery has not occurred.

The images of the products are displayed in the online store for presentation purposes. The products ordered may differ in certain characteristics (e.g., color shades) from the actual appearance of the product, depending on the batch in which they were manufactured.

In order to properly conduct the distance contract, ABCMOBILIER.RO S.R.L., with the client’s consent, may contact the client via email or phone if, following interaction with the site, they complete their identification and contact details. The purpose of this contact is to request specific information necessary for completing the online order process.

All prices for goods in the online store are expressed in Lei (RON) and include VAT. Product prices are updated daily. The price of the product ordered is the one displayed at the time the order is placed.

Promotions and discount codes are valid as follows:

For limited periods, specified on the product presentation page of the online store.
ABCMOBILIER.RO S.R.L. reserves the right to supplement and/or modify any information on the online store without prior notice to users of the site.

Communication with the online store www.abcmobilier.ro occurs during interaction by posting opinions regarding ABCMOBILIER.RO S.R.L. products and services, through the available contact form or by email at info@abcmobilier.ro. ABCMOBILIER.RO S.R.L. reserves the right to contact the website visitor by email or phone if, after interacting with the site, they complete their identification and contact details and explicitly request any available information.

Payment

An order for products presented on www.abcmobilier.ro, followed by the electronic confirmation message of the order, implies a payment obligation from the customer representing the sale price of the selected product(s) (hereinafter referred to as "Price" and/or "Prices").

Upon pressing/activating the FINALIZE ORDER button and receiving the electronic confirmation message, the customer agrees to pay the price of the selected product(s) to www.abcmobilier.ro.

We reserve the right to unilaterally and unconstrainedly modify the prices of products on www.abcmobilier.ro, according to our own interests. Before receiving any purchase orders from the customer, we reserve the right to introduce new prices, correct/rectify prices, offer or cancel discounted prices without informing the customer in advance.

Prices are indicated next to each product and are expressed in LEI (RON). The prices include VAT.

The customer can opt for one of the following payment methods:

Online payment through the secure platform of the payment processor agreed by ABCMOBILIER.RO S.R.L., namely the NETOPIA Payments platform, developed and managed by NETOPIA FINANCIAL SERVICES S.R.L., registered with the Trade Register under no. J40/12763/2020, with the unique registration code RO43131360, located in Bd. Dimitrie Pompeiu 9-9A, IRIDE BUSINESS PARK, Building 24, 4th floor, Sector 2, Bucharest, 020335.
Bank Transfer.
The customer makes the payment for the Price at the time of submitting their purchase order for the selected products on www.abcmobilier.ro. In the case of payment by bank card, the price is due at the time the customer receives the electronic confirmation message.

Intellectual Property Rights
The content of the website www.abcmobilier.ro, including but not limited to graphic signs, names, trademarks (such as the website and company name ABCMOBILIER.RO S.R.L.), symbols, images, texts, multimedia files, is the property of ABCMOBILIER.RO S.R.L. and cannot be taken and/or used without prior written consent from the owner.

Visitors to this site have the option to copy information from the site for personal, non-commercial use, without deleting or modifying it. Modifying or using the materials on this site for purposes other than information, or for use as a customer, is strictly prohibited.

By accessing this site, visitors agree that any name, logo, trademark, text, documents, and media files presented on this site are owned by ABCMOBILIER.RO S.R.L. and cannot be used by the user except for informational purposes. ABCMOBILIER.RO S.R.L. will take legal action if intellectual property and copyright rights are violated.

In case ABCMOBILIER.RO S.R.L. grants the Visitor/Client the right to use the website's content in a certain way, the visitor/client may only use it for the purpose defined and for a specific period as agreed upon. Any unauthorized modification of the site is prohibited.

Limitation of Liability
By accessing the site, you agree that its use is at your own risk. ABCMOBILIER.RO S.R.L. is not responsible for any direct or indirect incidents or any other losses, costs, or expenses of any kind that may arise from accessing or browsing the site or downloading data (texts, images, video, or audio).

Additionally, ABCMOBILIER.RO S.R.L. is not responsible for any damages caused by viruses, bugs, human actions, or any failure of the IT system or any other errors, faults, or delays in communications transmitted on devices.

All information and materials on this site are provided for free, with no guarantees. Under no circumstances will ABCMOBILIER.RO S.R.L. be responsible for any direct, indirect, incidental, or special damages resulting from the use or inability to use this site and will not be responsible for any damages resulting from errors, omissions, interruptions, mistakes, failures, delays in operation or transmission, or any non-performance of the site.

By creating and using a customer account, the user is responsible for maintaining the confidentiality of login data (access). The user must keep the username and password confidential and use them responsibly for managing orders and the facilities available in the customer account.

Users agree not to share or transfer passwords or any other access information to any third party. Users assume full responsibility for the use of the account and the confidentiality of the password. By accessing the site, creating the user account, and placing orders, the customer expressly and unambiguously accepts the Terms and Conditions of the site and the conditions in which the online order process takes place, as presented on the site.

ABCMOBILIER.RO S.R.L. is not responsible for damages resulting from the loss of purchased goods or from the use of the goods after delivery, except for the legal and conventional warranties provided.

ABCMOBILIER.RO S.R.L. reserves the right to change the terms and conditions of the site and the general conditions for the online order process at any time. The client confirms acceptance of these terms and conditions by checking the "I agree to the terms and conditions" checkbox. The remote contract is executed under the terms and conditions valid at the time of the agreement.

Use of the Site
In certain areas of the site, visitors can submit texts, files, images, photos, videos, audio files, or other user-generated materials. ABCMOBILIER.RO S.R.L. reserves the right to delete any content generated by a user that does not comply with the terms below. In this regard, users commit to the following:

Not to submit illegal, defamatory, slanderous, obscene, threatening, harassing, abusive, racist content, or violate intellectual property rights or other materials that may constitute or encourage behaviors that could be considered criminal;
Not to submit personal information or breach the confidentiality of another individual in any way, including sending their personal data;
Not to upload software materials on the site, links, or files containing viruses, corrupt files, or any other similar software or programs that may negatively affect the functioning of the site or its elements;
Not to modify the source code of the site or other technologies or applications integrated into the site, unless expressly authorized in writing by ABCMOBILIER.RO S.R.L.

Terms and Conditions for Posting Reviews About Products
This section aims to clarify the rules for posting reviews on the www.abcmobilier.ro site and to provide customers the opportunity to share their experiences after purchasing or using the products.

By posting a review about your experience with our products, you grant us the right to host, reproduce, and post verified opinions without obligating the company to make any payments to the user/client or a third party.

Recommendations and Rules for Posting Opinions on www.abcmobilier.ro

You may include suggestions about products sold by ABCMOBILIER.RO based on your purchase or use of the product to help other customers form an opinion about the product;
When expressing opinions, please refer to the characteristics and usage of the product, and not to aspects like delivery, offers, prices, etc.;
The information submitted should be realistic, truthful, either positive or negative, and the expression of the opinion should be strictly related to the features and nature for which the product was created;
Do not include personal data or confidential information about other individuals in your comment;
Reviews are published on the site within a maximum of 3 working days from the date of submission, if they meet legal criteria, after verification. Reviews are checked to confirm they come from consumers who have purchased or used the respective products;
Only reviews from consumers who have used or purchased the products and have an account on the www.abcmobilier.ro site will be published;
The name and surname set in the account are automatically included in the review posted on www.abcmobilier.ro and will be made public. If you do not wish your personal data (name and surname) to be made public, please set a public name (alias), and reviews posted after this setting will be published under this "alias";
We reserve the right not to publish reviews containing offensive language or defamatory comments or criticisms of other customers who have posted previous messages;
We reserve the right not to publish opinions or questions regarding stock, product availability, prices, delivery, and other details. For such requests, please use the contact form;
We reserve the right not to publish messages referring to products and offers of other companies, contacts, or any links to them (website address, email address, phone number, physical address, or other contact details);
We reserve the right not to publish reviews that intentionally mislead the customer, malicious or false opinions;
We will not publish false reviews or recommendations from consumers.

Advertising and Confidentiality
The buyer will not disclose any private information received from the seller to third parties by any means, under penalty of being required to pay damages.

The seller reserves the right to use the information provided by the buyer to execute the remote contract. The buyer also will not disclose any information about the order to any third party without the written consent of the seller.

The seller reserves the right, based on the user's consent, to store and use the information provided by the buyer for marketing purposes. The seller will not provide any third party with the information received from the buyer, except for agreed partners and service providers with whom there is a contract protecting this data.

Remarketing Terms
On the pages of the website www.abcmobilier.ro, cookies are collected using a remarketing tag and conversion code from Google AdWords. The Google remarketing tag collects cookies to display ads on websites in the Google Display network and in Google Search. When users visit a page of the site containing a remarketing tag, the cookie in their browser is added to a remarketing list.

Google AdWords uses these cookies to display sponsored ads on websites in the Google Display network and in Google Search to users who have visited pages on www.abcmobilier.ro. If visitors to the site do not agree with the use of cookies by Google, they can disable ad display through the Ad Preferences Manager. Billing and Issuing Accompanying Documents for the Package
The seller will issue an invoice based on the information held and provided by the buyer for the goods delivered.

The prices of the products displayed on the www.abcmobilier.ro site include VAT in accordance with current legislation. The customer is obligated to provide complete and accurate information necessary for issuing the invoice according to applicable legislation. ABCMOBILIER.RO S.R.L. will send the invoice related to the order both electronically, available in the "Customer Account," and in physical format upon delivery of the goods.

Risks and Responsibilities
The seller is responsible for the proper packaging of the goods.

The risk of loss of the goods is transferred to the buyer at the moment of actual delivery.

The buyer assumes responsibility for the delivery of the products ordered.

Delivery and Acceptance of Goods
Goods are delivered only within Romania, either through the solutions proposed by the Seller or by picking them up from the Showroom. The customer must pay the additional cost of the delivery service for the order. The buyer will take ownership of the goods after receiving the receipt from the courier and making the payment (if not made in advance by card or bank transfer) to the courier.

The estimated delivery time for the products or services is 10-15 working days.

The consumer (individual) has the right to return the products within 14 days from the purchase. Please refer to the product return policy.

Force Majeure
Force majeure (an unforeseen, uncontrollable, and inevitable event that affects the execution of the contract) exempts the party invoking it from liability.

Applicable Law
The contractual relationships between the parties are governed by Romanian law. Any disputes that cannot be resolved amicably will be submitted to the competent courts for resolution.
